Seasoned Employment Law Attorney Provides Insight into Employee Disability and Leave Laws

Fentin will host a webinar discussing how the Family and Medical Leave Act (FMLA), Americans with Disabilities Act (ADA) and Workers’ Compensation overlap in the workplace.

Recently the United States Court of Appeals for the Tenth Circuit issued a ruling in which the court suggested that a policy with a strict limit on medical leaves of absence might be enforceable. This ruling leads to many questions, for instance:

  • Can an employer have a policy with strict limits on medical leave and what risks are associated with the policy?
  • What happens if an employer eliminates an employee’s position while they are out on leave or discovers evidence of wrongdoing while the employee is on FMLA?
  • Can the employer refuse to reinstate the employee to a previous position?

Seasoned employment law attorney, Susan G. Fentin, will provide real-life examples of the many situations that may arise and trigger multi-layer obligations under FMLA, ADA and Workers’ Compensation. These problem solving strategies will help human resource managers evaluate how to handle each situation correctly to avoid liability.
