Law Rulings Explained 

This briefing will discuss several recent United States and Massachusetts Supreme Court Decisions and their impact on employers:

  • Vance v. Ball State University (Workplace Harassment):  The United States Supreme Court issued an important decision in that helps define whether an employer is liable for workplace harassment.
  • University of Texas Southern Medical Center v. Nassar (Retaliation):  The Court examined the level of proof necessary for a plaintiff to demonstrate that his employer engaged in unlawful retaliation.
  • United States v. Windsor:  The Court issued a major decision striking down the Defense of Marriage Act (“DOMA”), which prohibited the federal government from recognizing same-sex couples.  The decision will have an immediate impact for employers in the following areas:
    • Family Medical Leave Act
    • Employer-Sponsored insurance plans
    • Retirement and pension plans
  • Sandifer v. U.S. Steel (Wage and Hour):  The Court will issue an opinion on whether “changing clothes” is compensable work time.
  • Flagg v. AliMed (Handicap Discrimination):  The Massachusetts Supreme Judicial Court is set to rule on whether an employee who is not handicapped can sue for handicap discrimination solely on the basis of that person’s association with someone else who is handicapped.
  • Patient Protection and Affordable Care Act (Obamacare):  Key reminders about health-care reform following the United States Supreme Court’s historic decision last year.
