Massachusetts’ New Pay Equity Law: What Employers Should be Doing Now

The amended Massachusetts Pay Equity Law, which goes into effect on July 1, 2018, imposes significant responsibility on businesses to ensure equal pay to employees of different genders for “comparable” work.  But what is “comparable” work, and when is it acceptable to pay employees differently based on the job itself or their tenure with the company?  What is the legal risk associated with failure to comply with the Pay Equity Law, and what can be done to mitigate this risk?  Attorneys Holstrom and Klimczuk will also discuss a unique feature of the law:  an affirmative defense against Massachusetts Pay Equity Law claims for employers that have completed a “good faith” pay audit and can demonstrate that “reasonable progress” has been made towards eliminating unlawful wage disparities.  The presentation will also explore implicit bias and how it may lead to pay discrepancies, as well as how to minimize the effects of implicit bias in your organization.
