Wage and Hour Law Update: Navigating 2024 and Beyond

Employers everywhere are being targeted by a wave of collective, class, and individual lawsuits asserting violations of the Fair Labor Standards Act, the Massachusetts Wage Act, and other state wage and hour laws.  The only way for employers to protect themselves from such lawsuits is to ensure that they are complying with all applicable wage and hour laws, which is challenging because the laws continue to change and be interpreted while employers face other challenges.  For example, the U.S. Department of Labor has proposed major changes to the overtime exemption rules that will impact pay practices of thousands of businesses here and across the country, and cost employers an estimated $1.2 billion in the first year alone.  Plus, employers are continuing to confront challenges associated with remote workers, such as which state’s wage and hour compliance laws apply.
