Employers’ 2022 EEO-1 Reports Due Soon

The United States Equal Employment Opportunity Commission (EEOC) has announced that it has opened the 2022 EEO-1 Component Data Collection.  All private employers that are covered by Title VII and that have 100 or more employees are required to file an EEO-1 Component 1 report.  If you are a federal contractor with 50 or more employees, you may also be required to file one.  Covered employers must file their reports electronically by Tuesday, December 5, 2023

The EEO-1 Component 1 report is a mandatory annual data collection requiring all covered employers to submit certain workforce demographic data, including by job category and by sex and race or ethnicity of their employees.  There are 10 major job categories: Executive/Senior Level Officials and Managers; First/Mid-Level Officials and Managers; Professionals; Technicians; Sales Workers; Administrative Support Workers; Craft Workers; Operatives; Laborers and Helpers; and Service Workers. 

As for race and ethnicity, there are 7 categories: Hispanic or Latino; White; Black or African American; Native Hawaiian or Other Pacific Islander; Asian; American Indian or Alaska Native; and Two or More Races.  All individual EEO-1 reports are kept confidential pursuant to the confidentiality provisions of Title VII.

According to the EEOC, EEO-1 data is used by the EEOC to investigate charges of employment discrimination against employers in private industry and to publish periodic reports on workforce demographics.  Because individual reports are confidential, any reports the EEOC publishes based on EEO-1 Component 1 data include only aggregated EEO-1 Component 1 data that protect the confidentiality of each employer’s information, as well as the privacy of each employee’s personal information.

To meet the December 5, 2023 deadline, the EEOC encourages eligible filers to begin the filing process as soon as possible.  For more information, you can find the EEOC’s website on this topic: https://www.eeocdata.org/eeo1.  On the website, there is an instruction booklet that consolidates existing support materials, including frequently asked questions and fact sheets, to clarify eligibility and reporting requirements.
